The Virginia Supreme Court today overturned the ruling in favor of Botetourt County in the case of Virginia Baptist Homes, Inc. v. Botetourt County.
The theory at trial was that The Glebe, being a resort retirement community, was not operated exclusively for religious or benevolent purposes. The trial court agreed and ruled it had to pay real estate tax.
The Virginia Supreme Court today reversed the decision. The only inquiry, according to the Virginia Supreme Court, was whether or not The Glebe operated a retirement community.
Both Justice Lawrence L. Koontz, Jr., who is from Salem, as well as the Chief Justice of the Virginia Supreme Court disagreed and filed strong dissents.
